The Massachusetts Lemon Law: When Your New Vehicle Goes Sour - Lemon Law Books
Have you ever purchased a brand new vehicle, only to find yourself constantly dealing with mechanical issues? There's nothing more frustrating than spending your hard-earned money on a lemon. Luckily, for Massachusetts residents, there is a law in place to protect consumers from such situations - The Massachusetts Lemon Law.
The Massachusetts Lemon Law ensures that consumers who purchase or lease defective vehicles are entitled to certain remedies. If you find yourself stuck with a lemon, this law can help you get the compensation you deserve.
What is The Massachusetts Lemon Law?
The Massachusetts Lemon Law, officially known as Chapter 90, Section 7N 1/4 of the Massachusetts General Laws, provides protection to consumers who purchase or lease new vehicles that turn out to be defective. Under this law, if your vehicle has a substantial defect that impairs its use, value, or safety, you may be eligible for a refund or replacement vehicle.

In order for your vehicle to qualify under the Massachusetts Lemon Law, the defect must occur within the first year of ownership or before the vehicle reaches 15,000 miles, whichever comes first. Additionally, the defect must be reported to the manufacturer or authorized dealership within this period.
How Does The Massachusetts Lemon Law Work?
If you believe that your newly purchased vehicle is a lemon, here are the steps you need to take to file a claim under The Massachusetts Lemon Law:
- Document all Repairs: Keep a record of all repairs and maintenance performed on your vehicle. This documentation will be crucial in proving that the defect existed within the specified period.
- Notify the Manufacturer: Report the defect to the manufacturer or authorized dealership in writing. Be sure to include all necessary details, such as the date of purchase, vehicle identification number (VIN),and a description of the problems you've been experiencing.
- Allow Reasonable Attempts for Repairs: The manufacturer or dealership must be given a reasonable number of opportunities to repair the defect. Massachusetts law requires three or more unsuccessful repair attempts or a cumulative 15 or more days out of service.
- File a Lemon Law Complaint: If the defect is not resolved after these attempts, you can file a complaint with the Massachusetts Office of Consumer Affairs and Business Regulation. They will guide you through the process and may schedule mediation or arbitration to resolve the issue.
- Seek Legal Assistance if Needed: If your claim is still not resolved to your satisfaction, you have the option to hire legal representation and take the case to court. A lemon law attorney can guide you through the litigation process and fight for your rights.
Understanding Your Rights
The Massachusetts Lemon Law provides various remedies for consumers who have purchased a defective vehicle. Depending on the circumstances, you may be entitled to one of the following:
- Replacement Vehicle: The manufacturer may be required to provide you with a replacement vehicle of comparable value.
- Refund: You may be eligible for a refund of the full purchase price, including any finance charges, sales tax, and registration fees.
- Reimbursement of Associated Costs: If you incurred expenses related to the defect, such as rental car fees or tow truck charges, you may be entitled to reimbursement.
- Attorney's Fees and Court Costs: If you successfully prove your case in court, the manufacturer may be required to cover your legal fees and court costs.
Types of Defects Covered
The Massachusetts Lemon Law covers a wide range of defects that may render a vehicle unfit for normal use, significantly decrease its value, or pose a safety risk. Some common examples include:
- Engine failure or overheating
- Transmission issues
- Electrical system malfunctions
- Brake problems
- Steering or suspension defects
- Excessive noise or vibrations
- Defective airbags
When to Consult a Lemon Law Attorney
If you're facing difficulties with the manufacturer complying with your lemon law claim or need assistance navigating the legal process, it may be in your best interest to consult with a lemon law attorney.
A knowledgeable attorney specializing in lemon law can provide you with expert guidance and ensure that your rights are protected throughout the entire process. They have the experience to negotiate with manufacturers and can represent you effectively in court if necessary.
Dealing with a lemon can be a frustrating and costly experience, but thanks to The Massachusetts Lemon Law, consumers have legal protection if their newly purchased vehicle turns out to be defective. By understanding your rights and following the necessary steps, you can seek the compensation you deserve.
Remember to document all repairs, notify the manufacturer, allow reasonable attempts for repairs, and file a complaint if needed. If matters escalate, seeking legal representation from a lemon law attorney can provide you with the expertise needed to navigate the legal process successfully.
Now that you're equipped with knowledge about The Massachusetts Lemon Law, take action if you believe you've purchased a sour vehicle. Protect your rights and ensure you're not stuck with a lemon.
